Does a document need to be signed in the presence of a notary?

It depends, Documents requiring acknowledgments normally do not need to be signed in the Notary’s presence. However, the signer must appear before the Notary at the time of notarization to acknowledge that he or she freely signed for the purpose stated in the document.On the other hand, documents requiring a jurat must be signed in the presence of the Notary. A jurat indicates that the individual signed and gave an oath or affirmation in the presence of the Notary

Do you have a living trust or estate planning package that was sent to you and you must find a notary public to notarize the documents for you to send them back to the source? Can I get a copy of the notarized documents?

The notary does not retain copies and will return all original documents to the signer. If there is more than one signer, you may want to bring an extra set of documents for both signers to have an original. The notary can make copies but may charge an additional fee for printing.

What should I bring to my notary appointment?

IDENTIFICATION: Bring a government issued ID such as a driver’s license, passport or other government issued photo ID.

DOCUMENTS: Have instructions, documents or forms to be notarized. Documents should be complete but unsigned.

WITNESSES: Some documents require additional witnesses. Please check in advance to see if the notary can provide a witness or if you need to bring your own.

PAYMENT: Payment is due at time of service by cash, check, credit or debit.
